OFFICIAL RULES AND REGULATIONS
TO ENTER KOOL Days of Summer 2010 (the “Contest”), starting Friday, May 21, 2010, look for the KOOL Crew handing out KOOL water bottles with a numbered KOOL Card within them. The KOOL Crew will distribute KOOL Cards and water bottles throughout Victoria and its surrounding area, while supplies last. An announcement will be made on the KOOL Morning Show by hosts Robin and Brian announcing a range of numbers each weekday at around 8:10 a.m. PST between Monday, May 31, 2010 and Thursday, August 19, 2010 (excluding statutory holidays Thursday, July 1 and Monday, August 2) and telling listeners to call in for a chance to qualify (the “Announcement”). When you hear the Announcement, and if you possess a numbered 2010 KOOL Card within the stated range, call the KOOL FM contest line at 250.386.1073. In the event the entrant is outside of the local calling area, standard long distance rates as charged by the entrant’s long distance service provider will apply. The seventh (7th) caller through on the KOOL FM contest line, and with a numbered 2010 KOOL Card within the stated range, following the Announcement automatically qualifies to win a Secondary Prize at the KOOL Days of Summer Wrap Party and qualifies for a chance to win the Grand Prize, as described below (each a “Qualifier”). The eligible Qualifiers will be announced on air and may be required to chat on-air. Each eligible Qualifier will then be required to provide a representative of 107.3 KOOL FM with their name and telephone number.
Two (2) KLUB KOOL members who have registered at http://www.1073kool.fm/klub_kool.htm (the “KLUB Kool Site”) and who complete and submit a KLUB KOOL Survey at the Klub Kool Site between May 21, 2010 at 8:00 a.m. PT and August 12, 2010 at 11:59:59 p.m. PT will be randomly selected to be Qualifiers. Limit of one entry per survey, but you can complete each separate survey posted on the Klub Kool Site and will receive one entry per completed and submitted survey. The draw will take place on Friday, August 13, 2010 during KOOL Mornings (between 7:00 a.m. and 9:00 a.m. PT)in Victoria, BC from amongst all eligible online entries. Selected entrants will be announced on air and notified by phone within two business days of the draw.
Contest starts on Monday, May 31, 2010 at 8 a.m. PST and closes on Friday, August 20, 2010 at approx. 7 p.m. PST (the “Contest Period”). There is one (1) Grand Prize and sixty-four (64) Secondary Prizes (collectively the "Prizes" and each, a "Prize") to be won during the Contest Period. Limit of one Secondary Prize per household. No purchase necessary. Void where prohibited.
The contest sponsors are: 107.3 KOOL FM, a division of CTV Limited, Saunders Subaru, Peninsula Consumer Services Co-operative and Maxxam Insurance Services Inc (hereinafter collectively referred to as the “Contest Sponsors”).
To enter and to be eligible to win a Prize, entrant must be a legal resident of British Columbia and be nineteen (19) years of age or older. Employees and their parents, siblings and children, and persons domiciled with an employee of any of the Contest Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. Winners of past KOOL Days of Summer Grand Prizes within the past two years are ineligible to win this year’s Grand Prize.
Grand Prize: There is one (1) Grand Prize consisting of a one-year lease on one (1) 2010 Subaru Forester Outdoor Package Model (automatic transmission), one (1) year of insurance for the car from Maxxam Insurance, and $1073.00 worth of gift cards to be used towards gasoline at Peninsula Co-op gas stations (expiration December 31, 2011). The Grand Prize winner must be 19 years of age or older, insurable with Maxxam Insurance’s coverage policies; not have a driving record during the lease period that will make insurance more expensive than for a normal driver of that age; and hold a valid British Columbia driver’s license during the lease period. Grand Prize winner must return the vehicle in the same condition as delivered, normal wear and tear excepted. Additional restrictions may apply. All original new vehicle warranties will apply to the vehicle during the course of the lease. Grand Prize winner must sign all required lease documents in order to be awarded the leased vehicle and must pick up the leased vehicle at Saunders Subaru no later than September 30, 2010. Acceptance is subject to rules & conditions. Selected of vehicle colour at sole discretion of the Contest Sponsors. Grand Prize is subject to such further terms and conditions as required by the Contest Sponsors in their sole discretion. Approximate retail value of the Grand Prize is $12, 000.00
Secondary Prizes: There are sixty-four (64) Secondary Prizes, as follows: Ten gift certificates valued at $150 for travel aboard Helijet; ten gift certificates valued at $150 to Spa Sirona; ten gift packages to Good Life Fitness for two x one-month memberships (valued at $200); ten gift certificates valued at $150 to Eye Etiquette; Ten gift certificates valued at $150 to Capitol Iron; Ten gift certificates valued at $150 to Glenwood Meats; four gift packs from KOOL FM, with surprise items, valued at $150 each (selection of colours and sizing of any clothing at sole discretion of the Contest Sponsors). Approximate retail value of each Secondary Prize is one hundred fifty Dollars ($150.00). The Secondary Prizes are awarded at the KOOL Days of Summer Wrap Party through a draw and prize board (as described below).
Prizes must be accepted as awarded. The Prizes may not be sold, transferred and are not convertible to cash. Contest Sponsors reserve the right to substitute the Prizes in whole or in part in the event that all or any component of the Prizes are unavailable.
The odds of qualifying for KOOL Days of Summer and winning a Secondary Prize through on-air entry will depend upon the total number of cards distributed at any time during the Contest Period, the range of numbers announced, and the number of card holders who call in to participate on each day during the KOOL Days of Summer qualifying period. The odds of qualifying for KOOL Days of Summer and winning a Secondary Prize through online entry will depend on the number of eligible entries received during the online entry period. 107.3 KOOL FM acting reasonably, will attempt to contact each potential winner by telephone within two (2) business days after that potential winner became the 7th caller to get through to the 107.3 KOOL FM’s contest line after the Announcement and within two (2) business days of the random draw in the case of the online entries. In the event a potential winner cannot be contacted within two (2) business days as noted above, he or she may be disqualified and that prize will be forfeited, except that eligible Qualifiers for August 18 and 19, 2010 must be able to be contacted immediately or will be disqualified and their invitation to the KOOL Days of Summer Wrap Party will be forfeited.
On Friday, August 20, 2010, from 4:00pm to 6:00pm PT 107.3 KOOL FM will host the KOOL Days of Summer 2010 Wrap Party at Saunders Subaru (1784 Island Highway, Victoria, BC)) where Qualifiers, in attendance, will be eligible to win a Secondary Prize and will be eligible for a chance the Grand Prize through a “Reverse Draw”. Qualifiers and one guest are invited to the KOOL Days of Summer Wrap Party.
Upon arrival to the KOOL Days of Summer Wrap Party, Qualifiers must register in order to be eligible for a chance to win a Secondary Prize or Grand Prize. To register, Qualifiers must present their KOOL Days of Summer 2010 qualifying card (for on-air Qualifiers), identification, phone number and address. If Qualifiers are unable to attend the KOOL Days of Summer Wrap Party, they may have someone register in their place. This must be arranged in advance through 107.3 KOOL FM. Replacement Qualifiers are ineligible to win the Grand Prize. Qualifiers must arrive to register between 3:30 p.m. and 4:15 p.m. PT. Qualifiers who arrive after 4:15 p.m. PT are ineligible to register to win a Secondary Prize or Grand Prize.
Once Qualifiers register, their name goes into an entry barrel. Between 5:00 p.m. and 6:00 p.m. PT, names will be drawn randomly from the entry barrel. As the names are drawn, the selected Qualifier will pick a square on the prize board to be eligible to win the corresponding Secondary Prize hidden beneath that square. The odds of winning each of the following Secondary Prizes: gift certificates to Helijet; Spa Sirona; Good Life Fitness; Eye Etiquette, TBD; TBD are approximately 1 in 6.5.. The odds of winning the KOOL FM gift pack are approximately 1 in 16... Any unclaimed Secondary Prizes will be forfeited. Once every Qualifier has selected a prize from the prize board, all eligible Qualifier’s names go into an entry barrel for the Reverse Draw and chance to win the Grand Prize. The last name drawn from the Reverse Draw barrel will be eligible to win the Grand Prize. Odds of a Qualifier winning the Grand Prize depend on the total number of eligible Qualifiers who register at the KOOL Days of Summer Wrap Party, but are no worse than 1 in 64.
Qualifiers must be present in order to win the Grand Prize.
Proof of identification and of the KOOL Card must be provided upon request for potential prize winners. In order to be declared a winner of a Secondary Prize and of the Grand Prize, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by 107.3 KOOL FM. Before being awarded a Prize, a potential winner will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that he/she has read and understood these official rules and regulations (“Rules”), grants all consents required, authorizes the Contest Sponsors to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsors from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that a potential Secondary Prize winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right to disqualify potential winner, and forfeit the prize, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
In the event that the potential Grand Prize winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right to disqualify potential Grand Prize winner, and the next last selected Secondary Prize winner will be eligible to win the Grand Prize, and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential Grand Prize winner, if applicable, shall be applied, with the necessary amendments, until a qualified Grand Prize winner has been duly selected.
By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.
All entries become the property of Contest Sponsors who assume no responsibility for garbled, in audible, lost, late, delayed, destroyed or misdirected entries or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of Prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest, and select a Grand Prize Winner from previously received Secondary Prize winners. Contest Sponsors reserve their right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.
Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsors for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsors will not sell or transmit this information to third parties except for the purposes of administering this Contest. Any inquiry concerning the personal information held by the Contest Sponsors should be addressed to 107.3 KOOL FM, 1420 Broad Street, Victoria, BC V8W 2B1.
In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Contest Rules shall prevail, govern and control.
All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
